By using our Services or opting in to receive communications from Subcore, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Messaging and SMS Services

By providing your mobile number and opting in, you consent to receive informational, transactional, or promotional text messages from Subcore.

  • Message Frequency: Message frequency varies by use case.
  • Message Rates: Standard message and data rates may apply.
  • Opt-Out: You may opt out at any time by replying STOP to any text message. After opting out, you may receive a one-time confirmation message.
  • Help: For assistance, reply HELP or contact support@subcore.ai.
  • Consent: Consent to receive text messages is not a condition of purchase.
  • Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.

Subcore complies with CTIATCPA, and all carrier guidelines for A2P (Application-to-Person) messaging, including consent, content, and opt-out requirements.

3. Use of the Services

You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. You will not:

  • Misuse or interfere with the normal operation of the Services.
  • Attempt to reverse engineer, modify, or copy Subcore’s software or AI systems.
  • Use Subcore’s Services to transmit unlawful, harmful, or unauthorized content.
  • Engage in fraud, phishing, or impersonation activities.

Subcore reserves the right to suspend or terminate access to the Services for violations of these Terms or misuse of messaging systems.

4. AI-Driven Interactions

Some parts of the Services use artificial intelligence (AI) to automate responses, analyze text, or facilitate workflows. You understand and agree that:

  • AI-generated responses are based on available data and may not always be accurate.
  • Subcore is not liable for decisions made based on AI-generated content.
  • Conversations may be monitored or logged to ensure compliance, improve performance, or support security audits.
  • All AI usage complies with applicable privacy, data handling, and consent regulations.

5. Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify Subcore immediately of any unauthorized access or security breach.

6. Intellectual Property

All content, software, and technology within Subcore’s Services—including AI models, designs, and workflows—are owned by or licensed to Subcore. You may not reproduce, distribute, or create derivative works without our written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Subcore and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from:

  • Your use or inability to use the Services;
  • Delayed, failed, or undelivered messages;
  • Errors or inaccuracies in AI-generated content;
  • Unauthorized access to your data.

Subcore’s total liability will not exceed the amount paid for the Services in the six months preceding the claim.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available.” Subcore makes no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose.

9. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you acknowledge and agree to our data practices as outlined in the Privacy Policy.

10. Compliance and Legal Disclosures

Subcore complies with all applicable laws governing data use, messaging consent, and electronic communications, including but not limited to:

  • Telephone Consumer Protection Act (TCPA)
  • CAN-SPAM Act
  • CTIA Messaging Principles and Best Practices
  • General Data Protection Regulation (GDPR) (where applicable)
  • California Consumer Privacy Act (CCPA)

11. Termination

We may suspend or terminate your access to the Services if you violate these Terms or if required to do so by law or carrier policies.

12. Changes to These Terms

We may modify these Terms from time to time. Updates will be posted on our website with a revised effective date. Continued use of the Services after an update constitutes acceptance of the revised Terms.
